Draft: these terms take effect when Bloomwilds launches.
The short version
- You need to be 13 or older, and to have a parent's or guardian's OK if you're not an adult where you live.
- Gems, Bloomlings and everything else in the game are yours to use in the game, not to sell or cash in.
- Purchases are final, except where the law or the store's refund policy says otherwise.
- Play fair: no cheats, bots, changed copies of the game, or selling accounts.
- Be kind with the names and gardens other players can see.
- We keep changing the game, and one day it may close. If it does, we'll tell you well ahead.
1. Agreeing to these terms
These terms are an agreement between you and Grand Parks Labs Ltd. (we, us). By downloading or playing Bloomwilds you agree to them and to our privacy policy. If you don't agree, please don't play. If you're not an adult where you live, a parent or guardian has to agree for you, and is responsible for what you do in the game.
2. Your account
You need to be 13 or older. One account each; you can link Sign in with Apple or Google to keep it on more than one device. Keep your devices and sign-ins safe: you're responsible for what happens on your account. Tell us straight away if you think someone else is using it.
3. Your licence to play
We give you a personal, non-exclusive, non-transferable licence to play Bloomwilds for fun, not for business, on devices you own or control, under these terms and the store's rules. You may not copy, change, sell, rent, decompile or hand out the game, except where the law says you may. We can end the licence if you break these terms.
4. Gems, Bloomlings and other items
Everything in the game (Gems and the other currencies, Wish Seeds, Bloomlings, cuttings, decorations, passes, and anything you earn or buy) is a licence to use it in the game. None of it is money or property: it has no value outside the game, can't be cashed in or exchanged for anything outside it, and can't be sold, traded or given away outside the game.
We may change how items work, what they cost and how often they appear, to keep the game fair and fun. Odds for random items are always shown in the game and on the odds page, and we update both before a change takes effect. If a bug costs you something, write to us and we'll do our best to put it back.
5. Buying things
- Purchases go through Apple or Google (or, on our web store, our payment provider) and follow their terms too. The price is shown before you buy, with any tax the store adds.
- What you buy arrives when the store confirms the payment.
- Purchases are final, except where the law or the store's refund policy says otherwise. Apple and Google handle refund requests for purchases made through them.
- If a purchase is refunded or charged back, we take back what it delivered, or what was bought with it.
- Passes and cards, such as the Sun Card and the Bloom Pass, last for the time shown when you buy them and don't renew on their own.
- In the EU and the UK, digital items are delivered as soon as you buy them, so the 14-day right to cancel ends once they are. The store asks you to agree to this when you pay.
- Wishes at the Wishing Pond bring random Bloomlings. The game shows the odds before every wish, and the guarantees it promises (such as a rare Bloomling within a set number of wishes) always apply.
6. Ads
Ads are optional: one plays only when you tap to watch it for a reward. The reward arrives once the ad network confirms the ad played, and there may be a daily limit. Rewards earned with bots, ad blockers or changed copies of the game don't count.
7. Playing fair
You agree not to:
- cheat, or use bots, scripts, macros or changed copies of the game;
- use a bug to get ahead (please report it instead);
- change your device's clock to hurry timers along;
- interfere with our servers or with anyone else's account;
- buy, sell, share or trade accounts, or anything from the game, for real money;
- pretend to be us or someone else;
- use the game to bully, harass or threaten anyone.
8. Names, gardens and what you make
Anything you make in the game (your gardener and Grove names, your garden's design) stays yours. You let us host it, show it and share it, inside the game and on our channels, to run and promote Bloomwilds, all over the world and without payment. That's how other players visit your garden, and how a garden can be the Admin's Pick on our social accounts. If you'd rather your garden wasn't featured, tell us.
Names and gardens mustn't be hateful, sexual, threatening or rude, include anyone's personal information, or copy someone else's brand. You can report a name or a garden in the game, and block a player. We may rename, hide or remove anything that breaks these rules.
9. If you break these terms
Depending on what happened, we may warn you, take back what was gained unfairly, reset progress, or suspend or close the account. Serious or repeated cheating or fraud can mean losing items you bought, except where the law says otherwise. We'll tell you what we did and why. You can ask us to look again by writing to us within 30 days, and a person will review it.
10. Changes to the game, and its end
We update Bloomwilds often, and may add, change or remove features, events and items. If we ever have to close the game, we'll tell you in the game at least 60 days ahead and stop selling Gems from that day. Unused items have no cash value and aren't refunded, except where the law requires it.
11. Other companies' services
Apple, Google, the ad networks, RevenueCat and Stripe provide parts of what you use in Bloomwilds, under their own terms. We're not responsible for their services.
12. What belongs to us
The game and everything in it (code, art, music, names and characters) belongs to us or to the people who licensed it to us. If you send us ideas or feedback, we may use them without owing you anything.
13. What we can't promise
We work hard to keep Bloomwilds running and fair, but we provide it as it is and as it's available. We can't promise it will always be available, free of bugs, or that progress can never be lost. Some places don't allow these exclusions, so some of them may not apply to you.
14. Limits on our liability
As far as the law allows, we're not liable for indirect or consequential losses, or for the loss of items' value, and our total liability to you is limited to what you paid us in the 12 months before your claim (or CA$50 if you paid nothing). Nothing in these terms limits liability that the law doesn't allow to be limited, such as for fraud, or for death or personal injury caused by negligence, or takes away your rights as a consumer.
15. Ending this agreement
You can stop playing at any time, and delete your account. We may suspend or end your access if you break these terms or the law requires it. Sections 4, 8, 12, 13, 14 and 16 still apply after the agreement ends.
16. The law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario. If you live somewhere whose consumer laws give you the right to go to your own courts, or to rely on your own laws (Quebec, the EU and the UK among them), you keep that right. Before going to court, please write to us: most problems can be sorted out in a few emails, and we'll try to within 30 days.
17. Changes to these terms
When these terms change, the date at the top changes too. We'll tell you in the game before an important change takes effect. If you keep playing after it does, you accept the new terms; if you don't accept them, stop playing and delete your account.
18. If you got Bloomwilds from the App Store
- These terms are between you and us, not Apple. Apple isn't responsible for Bloomwilds or what's in it.
- Your licence covers Apple devices you own or control, as the App Store's usage rules allow (Family Sharing included).
- Apple has no obligation to provide maintenance or support for Bloomwilds.
- If Bloomwilds fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund what you paid for the app itself, if anything. Apple has no other warranty obligation.
- We, not Apple, are responsible for any claim about Bloomwilds, including product liability, legal or regulatory requirements, consumer protection and privacy, and for any claim that it infringes someone's intellectual property.
- You confirm you're not in a country under a US government embargo, or on a US list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and can enforce them against you.
19. If you got Bloomwilds from Google Play
Google Play's terms apply too, and Google isn't responsible for Bloomwilds.
